If you are administering an estate for a deceased that was domiciled in the Republic of Ireland but with English or Welsh assets, you must also obtain a Grant Of Probate valid in England and Wales. How Does It Work?
Inheritance tax will be payable on the UK assets of the deceased. HMRC will want to be satisfied that the deceased was domiciled in the Republic of Ireland and a brief life history of the deceased is usually sufficient to prove this.
Documentation Required
If you are administering an estate for a deceased from the Republic of Ireland and need probate also for the English/Welsh assets, we will normally need:
- A copy of the Irish grant and will (the original or a certified copy will be required for submission to the Probate Registry here)
- Confirmation from the Republic of Ireland Solicitors that they have carried out the due diligence checks
- Details of the identity of the UK assets and any valuations obtained (or we can obtain these if needed)
- The statement as to domicile of the deceased
- The deceased's last address, occupation, marital status and details of surviving relatives
- Any UK tax reference
- Details as to gifts, joint UK accounts ,UK trusts, nominated assets or powers of attorney
Time Limits
If Inheritance Tax forms are delivered more than one year from the date of death there is a risk of a financial penalty being payable.
