Obtaining Grant Of Probate
What Is A Grant of Probate And How Do You Obtain One?
A Grant of Probate is an official document which the Executors may need to administer the estate. It is issued by a section of the Court known as the Probate Registry.
If there is no will (known as dying intestate) the process is more complicated and it leads to a grant of Letters of Administration by the Court.
Due to the complexities that may be involved in obtaining a grant of Probate or Letters of Administration many Executors or Administrators choose to instruct a Solicitor to undertake the work of administering on their behalf and the fees for doing so are paid out of the estate.
We can help you in completing the necessary paperwork and in particular we:-
- Write to all the asset holders
- Submit Tax forms and probate papers
- Obtain a Grant of Probate or Letters of Administration
- Gather in the assets, pay any debts from the assets and distribute the estate
- Prepare detailed estate accounts
Dealing with the affairs of someone who has died can take a long time. It is not unusual for it to take up to a year, perhaps longer if things are not straightforward. Many organisations may be involved e.g. banks, building societies, insurance companies the Land Registry, H.M.Revenue and Customs not to mention checking on changes of name and addresses of beneficiaries.
