Why Make A Will Guide - Are you concerned about the future?

Whilst many people are understandably concerned about the future of their assets, over half of all adult Britons have not yet made a will. Such an omission can be costly.

If a person dies intestate-without a will-their property possessions and cash will pass in accordance with arbitrary rules of law which may well not reflect their wishes. Their estate may also incur inheritance tax which could have been avoided or lessened. There is much "Folk law" about the intestacy rules which bears little resemblance to the truth and a meeting with a solicitor to check how they apply to you can help you to consider how you would like to command the future of your assets by making a will.

Failure to plan in advance can lead to uncertainty and stress for loved ones and deny you the guarantee that your final wishes will be respected. If you have a favourite charity they will only benefit after your death if you make a will. Such a legacy can make a real impact after you are gone. Legacies are estimated to be the biggest single source of voluntary income for charities.

Making a will signifies a positive move towards putting your affairs into order. Although it may seem overwhelming, it is actually an easy and inexpensive process. Now is the ideal time to get in touch with a solicitor who can help by ensuring that your will reflects your wishes, no matter whether the beneficiaries are your family, friends or a charity.

It is also a good idea to review your will at least every two years, since circumstances assets and requirements can change. Is your estate larger or smaller now? Has anyone come into or gone out of your life prompting a change in beneficiaries?

The Society of Trust and Estate Practitioners (STEP) who deal only in Wills, Trusts and Probate law, are advising that the changes brought about by the Finance Act 2006 (which removed a lot of tax planning schemes) make it all the more important that people commence their tax planning much earlier in life and continue to have a tax planning scheme in place for many years before they die. It is worth making a will if you have more than say £12,000 to leave and are over 18 years. The transitional period provided by the act came to an end on 5th April 2008 so this applies to all wills made now!
