Exploding myths - "I can't claim because the driver of the other car did not have insurance"

Believe it or not and contrary to the notion that we are a nation of claimants who will sue for any thing in the hope of getting compensation to which we are not entitled, there is still a belief that you cannot bring a claim if you are injured in an accident where the driver responsible was not insured to drive.

We are here to tell you that that is rubbish!

For many years now it has been possible make a claim in these circumstances and many injured motorists, cyclists and pedestrians have done just that.

Any such claim will be handled by the Motor Insurers Bureau (MIB) which is underwritten by all the motor insurers and will be dealt with them by them in-house or through one of their insurer agents or solicitors.

They will pay compensation (damages) for your injuries and loss of earnings and other expenses in the same way as the insurers of the driver responsible would have done had he been traced. They will however expect you to prove your case in exactly the same way as you would have done against an identified defendant and you therefore need as soon as possible after the accident to consult a specialist personal injury solicitor to deal with the process for you. You need help and advice concerning medical issues and the obtaining of medical and other expert reports to prove your claim. You need advice as to the full value of your claim and representation by a skilled and experienced negotiator.

When your claim is successfully concluded the MIB will also be responsible for your legal costs in the same way as if they had insured the responsible party.

Whatever your situation, if you are injured in an uninsured accident you should immediately seek expert legal advice to find out what your rights are and to start the accident claims process. A solicitor will quickly be able to make enquiries for you and find out whether you are the victim of an uninsured accident, or whether there is in fact a policy of insurance in place under which you can make your claim for compensation.
