Car Accident Injury?
What to do if you suffer a car accident injury?
If you are involved in a car accident and suffer an injury, what action should you take? What should you do immediately after the accident and what will happen depending on the type of injury that you sustain?
Immediately After The Car Accident
If you have been involved in a car accident you should immediately obtain the details of the other driver, including the make and model of the car, the registration number and full details of their insurance company.
You should obtain the names, addresses and telephone numbers of any witnesses to the accident as these may be helpful if you later make a claim for compensation.
If a serious injury has been sustained at the site of the accident the police should also be called. It is sensible to take photographs of the finishing position of the cars before you move them as these might be helpful in a subsequent claim.
Types Of Car Accident Injury?
There are various injuries which can be sustained during a car accident. The most common ones are :-
- Whiplash injuries (pain and suffering to the neck caused by overstretching the neck during the accident)
- Chest injuries caused by the seatbelt restraining the driver or passengers
- Fractures (to legs, arms, etc if there is a severe accident causing the vehicle to be heavily shunted or flipped over)
- Head or spinal injury for particularly serious car accidents
The extent and severity of the accident will determine the cause of action. If a minor injury is sustained the patient should visit Accident & Emergency for assessment and treatment. If more serious car accident injury is sustained an ambulance will have to be called to take the victim to hospital.
Treatment
Once again, the type of treatment will vary depending on the nature of the injury. However, the treatment might include physiotherapy or chiropractic treatment for soft tissue injuries the cost of which can be recovered as part of the claim for compensation.
If a whiplash neck injury is sustained it is likely that the General Practitioner or Accident & Emergency Department will recommend that you keep the neck mobile. Whereas rest used to be recommended and a neck collar was fitted, best practice now dictates that the patient keeps mobile.
Should you claim compensation for a car accident injury?
If you have suffered an injury and experienced an amount of pain and suffering, you may well decide to claim compensation. Even for a relatively minor injury the claim for pain and suffering often exceeds £1,000. When you add to this any claims for lost earnings, losses and expenses and private medical treatment then soon the claim can exceed £2,000. Obviously, the more severe the injury determines the amount of the award for compensation.
Summary
If you suffer an injury during a car accident, you should obtain all of the evidence needed to support a claim for compensation if you later decide to pursue one. You should obtain treatment from the hospital and follow up any further recommended treatment such as physiotherapy or chiropractic treatment. If you decide to seek compensation you should find a solicitor that will act for you on a ‘no win, no fee’ basis and will ensure that you keep all of your compensation if your claim is successful.
