Estate Agents and Home Information Packs

Research by the Law Society has found that some estate agents are using restrictive practices to tie clients to the use of their own Home Information Packs and in some cases will charge clients a surcharge to accept a HIP that has not been provided by them.

Law Society Vice President Paul Marsh says:

"If estate agents are skewing the market for their own advantage, it's contrary to the basic principles of competition law".

Many estate agents are receiving a commission to choose a HIP provider that will pay them a commission. This removes the client's freedom of choice.

Robert Gray, Senior Member of Gray Hooper Holt says:

"We are not saying that you should never obtain a Home Information Pack from an estate agent, we just want to make sure that all clients understand that they have a complete freedom of choice as to who they choose to prepare their Home Information Pack. If an estate agent tries to put pressure on you to use their pack, you can say no and choose it from another supplier.

Ultimately a Home Information Pack contains all of the legal documentation you will need to sell your house, and of course we believe that all of that information should come from the solicitor who will complete the legal process of buying and selling your home."
