Considering A Pre-Nup Agreement?
If you are thinking of getting married and you or your partner have substantial assets you wish to protect (or ring fence) from any potential claims in divorce proceedings, then you should consider a pre-marital contract. This will set out, for instance, what is to happen to both parties' assets upon divorce.
Do Pre-Marital Agreements Have Legal Standing?
There are some legal requirements which must be met before the Courts would give any weight to a pre-marital contract therefore it is extremely important that you take legal advice at least a few months before the wedding itself.
A pre-marital contract can be as short or as detailed as the parties' wish and it would be normal for both parties to make complete financial disclosure of their assets and to receive independent legal advice before entering into the contract. This may not be a very romantic thing to do but anyone who has been through a divorce previously would understand the importance of having some prior agreement in place insofar as the assets are concerned.
The important thing to appreciate is that a pre-marital contract is not legally binding and will not override a Court's jurisdiction to divide the parties' assets fairly under the circumstances, but a properly negotiated and signed pre-marital contract can sway the Court's decision in many cases.
