Considering A Cohabitation Agreement?
If you are living with somebody but you do not intend to get married, you may be surprised to learn that there is no such thing as a 'common law wife or husband'. If the relationship breaks down, neither party will have a claim against the other under Matrimonial Law and most arguments about assets and properties will be governed by Property Law. It is therefore very important that even before you start living with somebody you think about having an agreement so that if the relationship does not work out, you are aware of how the parties' assets will be dealt with.
A cohabitation agreement can deal with what happens to your pre-existing property assets or savings if the relationship breaks down and it can also deal with how ongoing household expenses are funded by each of you, whether equally or in different shares. It can also deal with a situation where one party dies without leaving a Will so that the surviving partner can remain in the property they shared as opposed to having to leave the property.
