If you are an employee you are entitled by law to receive a written statement of your terms and conditions of employment.
What Is Included In The Contract/Terms?
The contract should set out your full terms and conditions of employment, including payment terms, holidays, hours of work and any restrictive covenants. If no written contract of employment is prepared for you and you subsequently have a dispute with your employer, certain terms are implied. Therefore, even if you have no contract you still have employment rights.
What Terms Are Implied?
Terms are implied that are necessary to make your relationship with your employer work. These might include:
- The duty of mutual trust and confidence. You can rely on each other to be honest and respectful, for example you are trusted to respect your employer's confidential information, and your employer should not bully you.
- Sick pay (to be paid for a reasonable time but not indefinitely)
- Christmas closing
- Annual bonus payments
What If An Implied Term Has Been Breached?
If your employer has breached an implied term and this leads to loss or expense for you, or even dismissal from your employment, you may be able to claim compensation. We will look at the implied term and consider:
