A dismissal is classed as an unfair dismissal when an employee is dismissed from his job and the employer doesn't have a legally valid reason for terminating the contract and/or has acted unreasonably in the circumstances.
An employee can also be unfairly dismissed constructively (constructive dismissal) if the employer's actions left him with no alternative but to resign.
Length of Service To Qualify For Unfair Dismissal?
In most cases as an employee you will need to have at least one year's service to make a claim for unfair dismissal at the Employment Tribunal.
Compensation for Unfair Dismissal
If you are successful, you will receive basic compensation as laid down by law, plus compensation for loss of earnings and loss of other rights. You can also ask for your old job back or be re-employed by the employer in a different capacity as alternatives to receiving compensation.
