Why Have A Compromise Agreement?
A Compromise Agreement is usually used by an Employer when making staff redundant. The benefit for the employer is that the Compromise Agreement sets out all of the settlement terms, and most importantly, removes the employee's right to take any future legal action. Compromise agreements are recognised by statute and are the only way a claim can be legally binding without tribunal proceedings having been initiated. Your right to claim redundancy through an Employment Tribunal can arise, for example, from a failure by your employer to consult staff about the redundancy, or by failure to follow the correct process. However, once you sign the agreement your rights to take an Employment Tribunal claim are removed.

The main reason is that it removes any right to further compensation for your loss of employment. However, in addition to this your employer might use the Compromise Agreement to include Restrictive Covenants that prevent you working for a competitor, or from working in the same position within a specific geographic area.
