Mobile Phone Offence Law

Using a mobile phone whilst in control of a vehicle is an offence under Section 41D of the Road Traffic Act 1988. This carries a maximum penalty up to £1,000 for car drivers or £2,500 for HGV drivers and passenger vehicles carrying over 8 passengers. If you are successfully prosecuted you will also receive three penalty points. The minimum penalty for holding a mobile phone whilst driving is a £60 fine and three penalty points.
